McDonald's USA is asking a judge to dismiss it from a lawsuit over a spiked drink allegedly served to a Utah man.

McDonald's USA attorney Gregory Sanders represented the fast-food giant yesterday in Third District Court in West Jordan.

The man who filed the lawsuit claims a Diet Coke containing a heroin-like substance was served to him at a Riverton McDonald's in 2016.

The judge said he would take the request to dismiss the corporate giant from the lawsuit under advisement.

Sanders said McDonald's USA can't be held responsible for things that happen at franchised restaurants.
